Karnataka HC Exempts B.S. Yediyurappa From Personal Appearance In POCSO Case, Postpones Hearing Till July 26

The Karnataka High Court has adjourned the hearing of a petition filed by former Chief Minister B.S. Yediyurappa seeking to quash a Prevention of Children from Sexual Offences (POCSO) case against him. Additionally, the court, presided over by Justice Krishna S. Dixit, has exempted Yediyurappa from appearing personally before the Bengaluru court on July 15.

“Request for adjournment is allowed. Learned judge of court below is requested to grant exemption for the day, on the next date of hearing till any other day, till this matter is taken up for hearing on July 26,” the court said, scheduling the case for July 26 for further hearing.

The Fast Track Court 1 for POCSO Act cases had issued summons to the 81-year-old politician on July 4, requiring his appearance on July 15. The case was registered on March 14, based on a complaint by the mother of a 17-year-old girl, who alleged that Yediyurappa sexually assaulted her daughter during a meeting on February 2 at his residence in Dollars Colony, Bengaluru. Yediyurappa has denied the charges and stated his intention to fight the case legally.

The Criminal Investigation Department (CID), which is investigating the case, questioned Yediyurappa for over three hours on June 17 and filed a charge sheet on June 27. The High Court, a day later, extended its interim order preventing the CID from arresting Yediyurappa and allowed the prosecution to file objections to his petition. Following this, the court adjourned the hearing for two weeks, ending today.

The CID has accused Yediyurappa of sexually assaulting a minor girl and alleges in the charge sheet that he, along with three co-accused, paid money to the alleged victim and her mother to buy their silence. Yediyurappa faces charges under Section 8 of the Protection of Children from Sexual Offences (POCSO) Act providing with the offence of Sexual assault, and Sections 354A, 204, and 214 of the Indian Penal Code (IPC), dealing with Sexual Harassment, Destruction of document to prevent its production as evidence and Offering gift or restoration of property in consideration of screening offender, respectively.

The three co-accused—Arun Y.M., Rudresh M., and G. Mariswamy, aides of Yediyurappa—are also charged under Sections 204 and 214 of IPC.
