Kerala High Court Appoints Amicus In Plea Seeking Probe Into Bribery Charges Against Kerala CM & His Daughter

The Kerala High Court has appointed Advocate Akhil Vijay as an amicus curiae in the plea seeking a probe against high-ranking officials, including Kerala CM, Pinarayi Vijayan and his daughter.

The petition challenged the order of the Vigilance Special Court, Muvattupuzha, which dismissed a plea for an investigation into alleged illegal financial transactions between Cochin Minerals and Rutile Limited (CMRL) and Chief Minister Pinarayi Vijayan, his daughter T. Veena, and United Democratic Front (UDF) leaders, including the late Congress leader and former Chief Minister Oommen Chandy.

Justice K. Babu appointed the amicus curiae after the petitioner, Gireesh Babu, passed away while the appeal was pending before the high court.

The vigilance court had dismissed the complaint, stating that the complainant was unable to demonstrate the existence of a prima facie case against the accused and that it was merely an allegation.

The petitioner has sought the registration of an FIR by the Vigilance and Anti-Corruption Bureau. 

Allegedly, the political leaders had misused their official positions, causing a loss to the public exchequer.

Referring to the alleged payment of ₹1.72 crore by CMRL to Exalogic Solution, the plea further recounted that Settlement Board-II termed this transaction as a bogus transaction since no services were provided by Veena's firm to CMRL.

The complaint was filed after the interim settlement with the Income Tax Department, following which the payments made to the politicians by the company were disclosed.

The petitioner contended that the Vigilance Court dismissed the complaint without considering the facts and circumstances of the case.
