[Liquor Excise Policy Scam] Delhi HC Grants Interim Bail To Businessman Amit Arora Till August 30

Synopsis

Amit Arora, one of the directors of Buddy Retail Pvt. Ltd., was arrested by the Directorate of Enforcement in connection with the alleged Delhi Excise Policy Scam case.

The Delhi High Court, on Tuesday, granted interim bail to Businessman Amit Arora till August 30, 2024. Amit Arora had approached the court seeking interim bail on grounds of his medical condition. 

The bench of Justice Neena Bansal Krishna held, “Till the next date of hearing i.e., 30.08.2024, the applicant/petitioner is granted interim bail on account of his precarious medical condition”. 

The application was filed seeking interim bail until the pendency of his regular bail application on grounds of his medical condition. Senior Advocate Vikas Pahwa with Advocates Prabhar Ralli, Pranay Chitale, Namisha Jain, and Yuvraj Bansal notified the court that Amit Arora was suffering from a life-threatening disease and was admitted to the hospital. 

Senior Advocate Pahwa submitted prescriptions indicating that Arora was brought to the clinic with complaints of breathlessness, cough expectorant, dyspnea on exertion, and fever, leading to a referral for emergency admission. Subsequently, Arora was admitted into Arihant Hospital, where he was advised to receive oxygen and be admitted. 

Senior Advocate Pahwa notified the court that Arora was out on interim bail on grounds of his wife’s medical condition. It was further notified that the interim order was set to expire on August 21, 2024. 

Special Counsel Zoheb Hossain with Advocates Vivek Gurnani and Kartik Sabharwal accepted the notice and requested time to verify the medical documents submitted by Arora. 

Accordingly, the court granted bail to Amit Arora with the following directions:
a) Applicant/petitioner shall not leave Delhi/NCR without prior permission of the Court;
b) Applicant/petitioner shall appear before the Court as and when the matter is taken up for hearing;
c) Applicant/petitioner shall provide his mobile number and also the mobile number of his wife/surety to the IO concerned, both of which shall be kept in working condition at all times and he shall not change the mobile numbers without prior intimation to the Investigating Officer concerned;
d) Applicant/petitioner shall inform the IO and the Jail Superintendent the address where he shall be available in Delhi.
e) Applicant/petitioner shall also inform the IO of the Hospital where he is undertaking the medical procedure for his ailment and shall keep updating the IO on a weekly basis of the treatment undergone by him. 
f) Applicant/petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses
”. 

In January 2023, Amit Arora was granted bail by the Rouse Avenue Court for eight weeks as his wife was diagnosed with gallbladder stones and needed surgery.

Again, in September 2023, the high court granted bail to Arora for post-operative care after his surgery. Justice Dinesh Kumar Sharma observed that the jail might not have the requisite infrastructure for the care required by Amit Arora. 

Later in November 2023, he sought another bail on grounds of his daughter’s illness which was denied by the bench of Justice Swarana Kanta Sharma.
