Madhya Pradesh High Court to hear petitions on OBC quota in state government jobs

The Madhya Pradesh High Court will hear a bunch of petitions filed for and against the decision of the state government to raise quota for OBCs in state government jobs and for admission in educational institutions from existing 14% to 27% on August 1, 2022.

A stay on the operation of the law enacted to raise the OBC quota to 27% in the PSC and other recruitment exams was also ordered by the High Court.

Notably, an application moved by the state government to vacate the stay on September 1, 2021, was also turned down by the court while fixing the case for final arguments.

The petitioners challenging the legality of hike in OBC quota had contended that as per the law laid down in the Indra Sawhney case, the constitution bench of the supreme court has fixed the maximum limit of caste-based reservation at 50%.

Reliance has also been placed on the recent reiteration of its stand on the issue in the case related to Maratha reservation.

It is to be noted that if the OBC reservation is raised to 27%, the total reservation in the state government jobs and educational institutions will go up to 63%.
