Madras High Court Orders CBI Probe into Alleged Fake Notification of Petitioner's Appointment as Punjab and Haryana High Court Additional Judge

Against a litigant's claim of being an Additional Judge of the Punjab and Haryana High Court, Justice B Pugalendhi of the Madurai bench of the Madras High Court has ordered the Superintendent of Police, Central Bureau of Investigation (CBI), Madurai, to conduct an inquiry.

The court directed the Superintendent to authenticate a notification dated September 19, 2021, presented by the litigant, Captain Dr. VRC Pandiyan, alleging his appointment as an Additional Judge. The court further instructed the Superintendent to take legal action against those responsible for fabricating the notification and determine whether Pandiyan benefited from it.

Pandiyan had approached the court to challenge an order from the Chairman and Managing Director of the Tamil Nadu Small Industries Development, regarding the cancellation of a shed allotment. He had later made a payment and sought the execution of a sale deed, which was met with a one-time settlement demand. Pandiyan claimed his ability to successfully operate the unit and requested time to repay the amount.

During the proceedings, it was revealed that Pandiyan had sent representations to various officials, where he falsely portrayed himself as a High Court Judge.

The court, suspecting the authenticity of a notification presented by Pandiyan, initiated an investigation. In this regard, the court included the CBI as a party suo motu and ordered the High Court registry to provide Pandiyan's mobile phone and the requisite Section 65B certificate to the investigation officer.
