In its reply, the NIA stated that the acts committed by Raut were against the interest of society. The plea will be heard on July 12.
The National Investigating Agency, on Tuesday, in its reply to the bail plea filed by Bhima Koregaon accused Mahesh Raut, told the Bombay High Court that Mahesh Raut was a part of giving mileage to the subversive activities against the country.
"Raut is one of the members who is part of giving mileage to such subversive activities against this country. Hence he is not entitled to any relief keeping in view the gravity of the offence and its bearing on the State," the NIA said in its affidavit.
The NIA in its affidavit in reply before the Bombay High Court opposed the regular bail plea filed by Bhima Koregaon accused Mahesh Raut who sought bail on constitutional grounds.
The NIA in its reply stated that the acts committed by Raut were against the interest of the society “As such, it is not justifiable for an accused of such offence to seek relief on constitutional grounds when his acts are itself against the interest of state and society” the agency stated.
Further, the agency while opposing the bail plea stated that acts committed by Raut had a direct impact on the unity, integrity, security and sovereignty of India.
The reply also stated that the Naxalite-Maoist insurgency had “plagued this country” and caused the destruction of lives of people and police.
Raut had initially sought bail from the High Court after his plea was rejected by the special court in November 2021.
He was arrested in June 2018. In his plea, Raut claimed to be a forest rights activist who had studied in Nagpur and Nashik.
In its affidavit, the NIA stated that it had found evidence indicating that the Communist Party of India (Maoists) had provided Raut with ₹5 lakhs, along with co-accused Surendra Gadling and Sudhir Dhawale.
A bench comprising Justices AS Gadkari and SG Dige scheduled the bail hearing for Raut on July 12.
