‘Multiple Typographical Errors; File Corrected Petition’: Delhi HC In Somnath's Plea Against Election Of Bansuri Swaraj

Synopsis

Somnath alleged that Bansuri Swaraj engaged in corrupt practices during the May 25, 2024 Delhi voting. He claimed BJP workers had distributed money and goods, including sarees and salwar suits, to voters. 

The Delhi High Court, on Monday, directed AAP Leader Somnath Bharti to file a corrected version of his petition challenging the election of BJP MP Bansuri Swaraj, citing 'numerous typographical errors'. 

The bench of Justice Manmeet Pritam Singh Arora highlighted numerous errors that necessitated correction before any notice could be issued. The court specifically noted inconsistencies, such as the mention of a non-existent Respondent No. 4. 

Accordingly, the court listed the matter, while directing Somnath to file a revised petition, on August 13.

Background:

Bansuri Swaraj, representing the BJP, had defeated Bharti, the candidate from the INDIA alliance, in the election where the BJP secured all seven Lok Sabha seats in Delhi. Additionally, Bharti accused Swaraj’s agents of distributing pamphlets featuring her ballot number, photograph, election symbol, and an image of Prime Minister Narendra Modi on election day.

Somnath Bharti further accused the Bahujan Samaj Party (BSP) candidate, Raaj Kumar Anand, of being a BJP plant to assist Swaraj by diverting votes from the INDIA alliance candidate. Bharti alleged that Anand, formerly a minister in the AAP government in Delhi, had resigned under pressure from central agencies and subsequently contested the election on a BSP ticket, later joining the BJP. Bharti asserted that Anand had admitted to facing immense pressure from investigative agencies, leaving him no choice but to resign or face arrest.
