[Mumbai Ahmedabad Bullet Train] Bombay High Court Directs State Govt To Decide Godrej & Boyce's Plea Seeking Enhanced Compensation In 30 Days

Godrej & Boyce filed a plea asserting that while the initial compensation was determined at Rs. 572 crores, they were only awarded Rs. 264 crore

The Bombay High Court on Monday directed the Maharashtra Government to decide the plea filed by Godrej & Boyce seeking enhancement of compensation for land acquired by the government for construction of the Mumbai Ahemdabad Bullet Train Project. 

A division bench of Justice PB Collabawala and Justice MM Sathaye disposed of the petition today after hearing the parties.

"There is a delay in filling the application. Considering facts and circumstances we direct that the application filed by petitioner dated 28 feb within a period of 30 days from today. The writ petition is disposed of," the bench ordered.

Godrej & Boyce filed a plea asserting that while the initial compensation was determined at Rs. 572 crores, they were only awarded Rs. 264 crore. The plea sought an increase in the award to Rs. 993 crore from the government.

Godrej initially approached the Land Acquisition, Rehabilitation, and Resettlement (LARR) seeking an order to direct the deputy collector to decide its application. However, the LARR rejected Godrej's request, stating that it could not issue such a directive to the deputy collector.

In February 2023, the high court dismissed the plea filed by Godrej challenging the acquisition by the government. The high court's order was upheld by the Supreme Court. 

In response to the LARR's rejection of their request, Godrej filed a plea before the high court. This new plea sought a directive for the LARR to decide on their application and an increase in compensation to Rs. 993 crores.

Godrej's plea before the high court stated that "The inaction on part of the respondent authorities constitutes a clear case of abdication of powers and functions vested in them. The inaction is completely arbitrary, unreasonable and capricious," the plea stated.

The 508-kilometre track of the Mumbai Ahmedabad Bullet Train Project covers 21 kilometers of underground track. One of the entry points of the underground track is above the land owned by Godrej and Boyce.
