The Supreme Court earlier had taken strong note of his interview with a news channel about the West Bengal School Service Commission recruitment scam case
The Calcutta High Court Judge, Justice Abhijit Gangopadhyay on Friday passed a suo moto order directing the Secretary General of the Supreme Court to produce the report and official transcript of his interview which was placed before the apex court because of which the CJI-led bench directed to reassign the School jobs scam matter to another judge.
The Supreme Court convened an extraordinary session at 8 p.m. on Friday to examine an unusual ruling issued by Calcutta High Court Justice Abhijit Gangopadhyay.
The Supreme Court reversed the Calcutta high court judge's ruling at its 8 p.m. meeting. Further, the apex court stated that the order from the high court judge to the Supreme Court officer was not correct in terms of "judicial discipline."
The Division Bench headed by the Chief Justice of India DY Chandrachud and Justice PS Narasimha earlier while hearing a challenge by TMC leader Abhishek Banerjee against the High Court order of a CBI probe against the leader had directed the Calcutta High Court Judge to assign the matter to another bench.
The order was passed in light of the fact that Justice Gangopadhyay had given an interview to the news channel ABP Ananda in which he had made some comments against Banerjee, even as he was hearing the case.
“For the sake of transparency, I direct the Secretary General of the Hon’ble Supreme Court of India to produce before me the report and the official translation of the interview given by me in media and the affidavit of the Registrar General of this Court in original, forthwith by 12 midnight today,” Justice Gangopadhyay stated this yesterday.
Justice Gangopadhay had passed this suo moto order on Friday just hours after the Supreme Court asked the Acting Chief Justice of the Calcutta High Court to reassign the case involving the West Bengal Primary Teachers' Recruitment Scam to another court.
He said that he will be waiting in his chamber till 12:15 am “to get the said two sets in original which were placed before the Hon’ble Judges of the Supreme Court today.”
The Apex Court had passed yesterday's order in response to a plea by Banerjee against the High Court’s order calling for a probe against him by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED).
The top court had previously stayed the April 13 judgment ordering a probe by the Central agencies into Banerjee’s alleged role in irregularities in the recruitment of teaching and non-teaching staff at government schools.
