NGT Issues Notice To Centre Over Alleged Illegal Constructions In Noida and Greater Noida

Synopsis

The applicant claimed that the said illegal constructions using topsoil led to extensive illegal topsoil mining, causing deep pits and initiating a harmful cycle

The National Green Tribunal, chaired by Justice Prakash Shrivastava and Expert Member A. Senthil Vel has issued notice to the Union Government, instructing to file a response concerning alleged illegal constructions in Noida and Greater Noida.

The tribunal received an application from one Rajendra Tyagi, asserting significant unauthorized and illegal construction activities ongoing in Greater Noida and Noida, violating environmental regulations.

Advocate Akash Vashishtha, representing the applicant, emphasized that these constructions were utilizing topsoil, thereby instigating widespread illegal mining of topsoil in the vicinity of the villages. This practice led to the formation of extensive and perilous pits, consequently initiating a detrimental cycle of environmental degradation. This, in turn, resulted in hazardous, extensive craters, perpetuating a harmful environmental cycle.

Advocate Vashishtha alleged that these constructions proceeded without obtaining the mandatory Consent to Establish and Operate as mandated by Section 25 of the Water (Prevention and Control of Pollution) Act, 1974, from the Uttar Pradesh Pollution Control Board (UPPCB).

Moreover, Advocate Vashishtha contended that these illicit developments lacked proper sewage infrastructure and failed to acquire the necessary Consent to Establish and Operate under the Air (Prevention and Control of Pollution) Act, 1981, as well as the required NOC for water extraction from tube wells.

Advocate Vashishtha highlighted that, according to UPPCB, no information regarding these developers/developments was available in office records. Additionally, he presented photographs illustrating unauthorized constructions breaching environmental laws.

The tribunal acknowledged that this case raised significant concerns regarding compliance with environmental regulations. Consequently, a notice was issued to the Union Government, demanding a response.
