NIA Court Ernakulam convicts three in Kalamassery bus burning case

Synopsis

The case pertains to the Kalamassery bus burning incident wherein damage was caused to a Tamil Nadu government bus plying between Ernakulam and Salem in support of a demand for the release of Abdul Nasar Madani, Chairman of People’s Democratic Party (PDP), who was detained in Coimbatore Jail.

The National Investigation Agency (NIA) Special Court, Ernakulam on Wednesday i.e July 27, 2022, convicted three accused persons in the Kalamassery bus burning case.

In the incident, a Tamil Nadu government bus plying between Ernakulam and Salem was torched in support of a demand for the release of Abdul Nasar Madani, Chairman of People’s Democratic Party (PDP), who was detained in Coimbatore Jail.

The investigations have established that the accused persons had entered into a criminal conspiracy in the first week of September 2005 to wage war, strike terror, and damage government property in retaliation to the continued detention of Madani.

"The accused persons had assembled on September 8, 2005, at Aluva Masjid and chalked out their plan, at the instance and instigation of accused Majid Parambai and Sufia, to set fire to a Tamil Nadu government-owned bus, '' the NIA press release stated.

The NIA press release further stated that after a thorough investigation, NIA filed a charge sheet against 13 accused persons on December 17, 2010.

The three accused persons namely, Nazeer Thadiyantavidatha @Ummer Haji @Haji, Sabir Buhari, and Thajudin were booked under Sections 120B (punishment of criminal conspiracy), 121A (conspiracy to commit offenses, like waging or attempting to wage war or abetting waging of war, against the Government of India) of the Indian Penal Code (IPC) and Sections 16(1)(b) (punishment for the terrorist act) and 18 (punishment for conspiracy, etc.) of Unlawful Activities (Prevention) Act (UAPA).

“The quantum of punishment will be pronounced on August 1, 2022,” the NIA press release stated.
