Senior Advocate Sanjay Hegde, represented by Advocate Pranjal Kishore, asserted that his Twitter account was suspended due to ‘the use of a famous anti-nazi picture on his profile’. This action, he claimed, occurred without any prior notice or objections being raised. He further claimed that ‘there is no assurance that the account will not be suspended again’.
The Delhi High Court, through an order dated December 11, directed Twitter to restore the suspended account of Senior Advocate Sanjay R Hedge. The bench of Justice Tara Vitasta Ganju stated that “no action shall be taken against the Petitioner by the Respondent No. 2, except in accordance with the law and applicable statutory rules and guidelines”.
However, Advocate Ankit Parhar for Twitter, informed the court that Hedge’s account was already restored and thus keeping this case pending 'would only be an academic exercise'.
Advocate Kishor however claimed that the social media giant had restored the account only after the writ petition was filed despite the fact that the pictures which were under objection are still 'reflected on the account'.
Advocate Kishor further argued that 'Since there is no explanation by the Respondent No. 2 for why the account was suspended and later restored', there was no reason to believe that the account would not be suspended again arbitrarily.
The court, therefore, passed the appropriate orders and disposed of the petition.
