"No chance of High Court hearing the appeal early": Supreme Court grants bail finding that Appeal was pending for more than 5 years

The Supreme Court on June 22, 2021 granted bail to the petitioners whose appeal was pending before the Allahabad High Court for more than five years.
Vacation bench of Justice Dinesh Maheshwari and Justice Vineet Saran while enlarging the petitioners convicted for an offence under section 302 IPC by the Trial Court said, “Considering the facts and circumstances of the case and keeping in view that the petitioners have already undergone more than 10 years of incarceration, we find it to be a fit case for grant of bail.”
To this the court also directed the Trial Court to impose terms and conditions on the petitioners while being released on bail.
Appearing for the petitioner, Adv Nagendra Singh contended that the petitioners had already undergone incarceration for more than 10 years and that there were no chances of the criminal appeal being heard by the High Court early.
The Court in the present matter was hearing a bail plea in relation to the judgement dated April 18, 2016 in CRMBA No. 101721/2013 passed by the High Court Of Judicature At Allahabad.
