The habeas corpus plea has been filed by Senior Advocate Ronga’s wife challenging his detention being in violation of guidelines established by the Supreme Court
A habeas corpus petition has been filed in the High Court of Jammu and Kashmir and Ladakh, seeking the release of Senior Advocate Nazir Ahmad Ronga, who was detained under the Jammu and Kashmir Public Safety Act, 1978 on July 11 this year. The Public Safety Act permits a six-month detention without trial and has faced constitutional scrutiny since the abrogation of Article 370.
The plea, filed by Ronga's wife, Bilquees Ronga, argues that the grounds for his detention are baseless and malicious. It further alleges that the authorities did not follow the Supreme Court's guidelines in the DK Basu case during the arrest, which is a violation of Ronga's fundamental right to life and liberty. Additionally, the petition demands ₹60 lakhs in compensation for alleged illegal detention and torture, alleging that the detention has harmed Ronga’s reputation and career prospects.
Ronga, a former President of the Jammu and Kashmir High Court Bar Association, was detained by Jammu and Kashmir police at his residence in Srinagar and was initially lodged at the Nishat police station. He was later shifted to Kot Bhalwal jail in Jammu. At the time of his detention, his family was not informed of the Public Safety Act charges. The detention order, issued by the District Magistrate of Srinagar on July 10, was intended to prevent actions prejudicial to state security.
The High Court is scheduled to hear the petition on September 18, 2024.
