Plea Before Bombay High Court Seeks Cancellation of Bail Granted To NCP Leader Nawab Malik in PMLA Case

A plea has been filed in the Bombay High Court seeking the cancellation of bail granted to former state minister and NCP Ajit Pawar faction leader, Nawab Malik.

The application, moved by Samson Pathare, seeks cancellation of the interim bail granted to Malik on the grounds of alleged violation of bail conditions.

Malik is contesting in the upcoming Maharashtra Assembly election from the Mankhurd Shivaji Nagar constituency.

In July this year, Malik was granted medical bail by the Supreme Court of India after a single-judge bench of the Bombay High Court rejected his medical bail application.

The application filed by Pathare states that bail was granted to Malik because he required hospitalization and continuous treatment; however, he has not undergone any medical surgery or treatment.

“..the judicial principle upon which he was granted interim bail which was taken by citing extreme deteriorating medical condition of the Respondent No.2 which needed hospitalization and continuous treatment. However, the Respondent No. 2 neither underwent any medical surgery or hospitalization for the treatment of Kidney nor he is any kind of critical or medically unfit condition for the purpose of which the Hon'ble Supreme Court had granted him interim bail,” the plea reads.

The application also states that, in furtherance of his election campaign, Malik has been extending threats to witnesses to alter their stance before the Special PMLA Court, which constitutes a clear violation of the conditions imposed by the bail order.

Furthermore, it argues that Malik’s engagement in election campaigns, often outside the jurisdiction of the PMLA Court in Mumbai for extended periods, is also in direct contravention of the imposed conditions.

Therefore, the application seeks the cancellation of the bail granted to Malik.
