Synopsis

The FIR against Zubair was lodged for allegedly torturing and harassing a young girl on Twitter.

The Delhi High Court on Thursday asked the Delhi Police as to what actions had been taken against the man who made offensive tweets against Alt-News Co-Founder Mohammed Zubair in 2020, prompting an FIR under the POCSO Act to be filed against him.

A single-judge bench comprising Justice Anup Jairam Bhambhani said, “I want to see if the Delhi Police found no criminality in Zubair's tweet; what action they have taken against the person who put out the offensive tweets”.

“What did you do about this gentleman called Jagjit Singh? My question is- if you found nothing against Zubair, what did you do about the person who put out those offensive tweets,” Justice Bhambhani inquired the Delhi Police.

Furthermore, the single-judge bench remarked, "Somebody starts a storm (Singh) and you (Delhi Police) just say this person's (Zubair's) name is not in the chargesheet. I want to see if things are coming to a logical closure”.

The court also sought the status of the FIR registered against Zubair in Chhattisgarh.

During the hearing, Advocate Urvi Mohan, appearing for Zubair, contended that they wish to withdraw the plea. She requested the court to note in the order that the matter is being withdrawn because the chargesheet does not include his name.

Taking note, the court listed the matter for further consideration on March 13.

It is to be noted that on January 5, the bench asked counsel for Zubair to seek instructions on whether they want to withdraw the application seeking direction to quash FIR registered against him for allegedly torturing and harassing a minor girl on Twitter. The court had also asked the Delhi Police to place a copy of the chargesheet.

The present plea relates to a prayer seeking quashing of the FIR registered against Zubair for allegedly torturing and harassing a minor girl on Twitter.
