"Registration of an FIR cannot be a ground for suspension of registration certificate": Navneet kalra tells Delhi Court on show cause notice suspending license of his Restaurants

The Delhi high court today sought response from the Additional Commissioner of Police, Licensing, Delhi on a plea by businessman Navneet kalra challenging the show cause notice suspending registration  certificate to run his two restaurants, Khan Chacha and Townhall

Senior Advocate Maninder Singh appearing for kalra relying on Section 141 of the Delhi Police Act and the High Court Judgement in Dilip J Bhatia vs Commisioner of Police argued that the order was passed without jurisdiction since registration of an FIR cannot be a ground for suspension of registration certificate.

Advocate Santosh Kumar Tripathi appearing for the licensing branch of the Delhi Police  however said that the renewal of the certificate was denied by the Municipal Corporation and not the Delhi Police.

Justice Rekha Palli however said that Kalra has already been aquitted by the Court and could not be compelled to approach the Court for running his restaurants.

Accordingly, the bench directed Tripathi to seek instructions in the matter and listed the matter for next hearing next week.

The licensing branch of Delhi Police in June had suspended the arms license of businessman Navneet Kalra, accused in a case relating to the alleged hoarding of oxygen concentrators in South Delhi.

In May, a Delhi court had granted bail to businessman Navneet kalra accused of black marketing and selling oxygen concentrators at an exorbitant rate.

The Court granting bail to Kalra had said that the accused not joining the probe pending a decision on his anticipatory bail pleas, in the absence of any interim protection by superior courts, does not mean he should be denied relief.
