Bollywood actor Anushka Sharma's on Thursday informed the Bombay High Court that she would file an appeal against the order of the Sales Tax Department in the appellate court after the high court said that there was an alternative remedy available to Sharma
A division bench of Justices Nitin Jamdar and Abhay Ahuja said that they would reject the petition as there was an alternative remedy of statutory appeal available. Sharma's lawyer informed the court that they would avail of the remedy of appeal, and the court granted Sharma four weeks to file an appeal.
"After hearing the petitions for some time, the petitioner's lawyer has informed it would avail the remedy of appeal. All contentions of the petitioner are kept open in the appeal. The petitioner is granted 4 weeks time to file an appeal" the bench noted
Sharma had challenged the orders passed by the Deputy Commissioner of Sales Tax at Mazgaon, Mumbai, which raised dues for assessment years 2012-13 and 2013-14 under the Maharashtra Value Added Tax (MVAT) Act. Her lawyer argued that the assessing officer had wrongly levied sales tax on the consideration she received for endorsements and anchoring at award functions.
The court said that the sales tax officer had probably interpreted the definition of rights over intangible property under the MVAT Act. The court added that whether Sharma had sold the copyright or not was a matter of factual consideration that the appellate court could decide.
The government pleader appearing for the sales tax department informed the court that there were agreement clauses to be considered and also examine the work Sharma undertook.
The court held that through this writ petition, Sharma was asking them to interpret the entry made by the sales tax officer regarding the sale of intangible goods, which was a matter of factual dispute. The division bench stated that if they passed a detailed order, they would reject the petition holding that there is a statutory alternate remedy.
