The Madhya Pradesh High Court on Monday issued a two-week returnable notice to the state in response to a petition seeking the revocation of the National Security Act (NSA) invoked against a person who reportedly urinated on a tribal man in Sidhi district.
According to a report in The Print, a division bench comprising Chief Justice Ravi Malimath and Justice Vishal Mishra issued letters to the state and the Sidhi collector seeking their responses.
Kanchan Shukla, wife of accused Pravesh Shukla filed a Habeas Corpus petition. Pravesh Shukla was accused of urinating on a tribal man, and a video of the event went viral on social media. He was then arrested and booked under several sections of the IPC, the ST/Sc Act, and the NSA.
In the plea, she stated that the NSA was used illegally against her husband Pravesh Shukla, who was arrested a day after a video of him peeing on a tribal man appeared on July 4.
According to her petition, Pravesh Shukla was a political party activist, and the opposition had built an atmosphere and narrative against him.
Through her plea, she also other than a few minor infractions in the past, her spouse had never committed a severe crime.
Further, she stated that the order violates Article 22 (5) of the constitution, which gives the person holding the right to file a complaint not only to the advisory board but also to the detaining authority.
The bench listed the matter on August 01, 2023.
