Special CBI court denies bail to Anil Deshmukh in corruption case

Synopsis

The Special CBI Court rejected the bail plea of Former Home Minister and NCP Leader Anil Deshmukh in the corruption case after noting that it is an economic crime that affects the country and the nation. The court also noted that the statement of the approver plays an important role in the corruption case.

A Special CBI Court, on Friday, rejected the bail plea of Former Home Minister and Nationalist Congress Party (NCP) Leader Anil Deshmukh in the case registered against him by the Central Bureau Investigation (CBI), in a 100 crore corruption matter.

Anil Deshmukh was being probed by the CBI for allegedly collecting hundreds of crores from bar owners in Mumbai. The case came to be registered after the allegation was levied by the Former Mumbai Commissioner Parambir Singh and a statement given by Sachin Waze who later became the approver in the case.

The Special Judge S.H Gwalani while rejecting bail of Deshmukh noted that "The statement of the approver recorded by additional magistrate plays an important role and therefore such statements cannot be overlooked."

The court took note of the admissibility of evidence at the stage of bail and noted that 

"Admissibility of the evidence cannot be answered at the stage of bail and that detailed examination of evidence cannot be taken at this stage."

Further, the court stated that "In the present case there is a huge amount of money involved and the economy of nation and country needs to be considered.”

The court also noted that Deshmukh is being provided with adequate medical facilities.

With Regard to the severity of the economic offense and comparing it to murder, the court stated that,

"Murder is committed in the spur of the moment but economic offenses are committed with calculations.”

The court while rejecting the bail noted that the court is not of the opinion that the accused shall be released on bail.

Additional Solicitor General had concluded his arguments yesterday, and the Judge had said that, "I will try to pass the order tomorrow" 

The advocate for the Former Home Minister Anil Deshmukh had relied on the bail granted by the High Court in a case registered against Deshmukh in the PMLA case by the Enforcement Directorate. He also informed the court about his health conditions in Deskhmukh and that he is undergoing an angiography at a private hospital.

The CBI had earlier opposed the bail plea of Anil Deshmukh Deshmukh and contended that he was served notice under Section 41A and on all the occasions the applicant did not join the investigation and, therefore, police custody was given. 

CBI had also argued that the court cannot go into the prima facie case and credibility of the witnesses at the stage of bail and conduct a mini-trial and that Deshmukh has been enjoying political and administrative connections in the capacity of elected representatives and that he may influence potential witnesses and tamper with the evidence.
