Srinagar Court Orders Arrest of Jitender Tyagi for Derogatory Remarks Against Islam and Prophet Mohammad

A Srinagar Court has ordered the Senior Superintendent of Police (SSP), Srinagar to create a special team to arrest Jitender Narayan Singh Tyagi, formerly known as Waseem Rizvi for allegedly making derogatory remarks against Islam and Prophet Mohammad.

The court of 2nd Additional Munsiff Court, Srinagar, presided over by Judge Vikas Bhardwaj, issued the order on February 20, 2025, emphasising the necessity of Tyagi’s arrest due to his repeated failure to appear before the court despite multiple notices. The court, as reported by ETV Bharat, has directed the SSP to ensure Tyagi's presence at the next hearing on April 25, 2025.

Despite several endeavours, the presence of the accused could not be secured. Therefore, in order to secure the presence of the accused, SSP concerned is hereby directed to constitute a team to arrest the accused and produce him before this Court by next date of hearing,” the court ordered.

The case stemmed from a complaint filed by Danish Hassan Dar before the Judicial Magistrate Court, Srinagar on December 15, 2021, after Dar did not receive a response to an initial complaint filed with the police. The complaint alleges that Tyagi, who converted from Islam to Hinduism on December 6, 2021, made disrespectful remarks against Islam and Prophet Mohammad while speaking to reporters in Lucknow. The remarks, which were televised on national channels including Aaj Tak and Zee News, and published in The Times of India on December 7, 2021, included calling the Quran “false and frivolous literature.”

The complainant alleged the commission of offences under Sections 153 (Promoting enmity between religious groups), 295A (Hurting religious sentiments), and 505 (Making statements that disturb public peace) of the Indian Penal Code (IPC), to have been committed by Tyagi.

Tyagi, formerly the Chairperson of the Uttar Pradesh Shia Central Waqf Board has previously, in 2021, filed a petition before the Supreme Court seeking the removal of certain verses from the Quran, leading to the registration of multiple FIRs against him.

The Central Bureau of Investigation (CBI) had also registered two FIRs against Tyagi for alleged irregularities in the sale and transfer of waqf properties in Uttar Pradesh.
