UP State Human Rights Commission seeks report from SP Farrukhabad in custodial death case

Allegedly, Gautam Singh Sisodia was arrested by the Local Police on the night of June 23 and was taken into custody. His family claimed that Sisodia was brutally beaten by the police causing his death after which the police left his body 100 meters away from his house.
In the alleged custodial death case of a 35-year-old man in Farrukhabad district of Uttar Pradesh, the State Human Rights Commission has sought a report from the Superintendent of Police of the area.
On a complaint filed by one Gajendra Singh Yadav dated June 25, the Commission ordered, "Looking to the nature of allegations made in the complaint it would be appropriate to call for a report from the Superintendent of Police, Farrukhabad who shall look into the matter and after necessary inquiry send his report to the Commission on 12.07.2022."
The matter will be next heard on July 13, 2022.
Yadav had filed the complaint with the Commission alleging that one Gautam Singh Sisodia was arrested by the Local Police on the night of June 23 and was taken into custody. Yadav had claimed that Sisodia was brutally beaten by the police causing his death after which the police left Sisodia's body 100 meters away from his house.
Important to note that the Supreme Court, in April this year, dealing with the custodial death case of a resident of State's Unnao district, observed that "fair investigation is the backbone of criminal justice system and the object of the investigation is to search for the truth so that it would help in meeting the ends of justice by way of fair trial in Court."
In the Unnao case, the mother of the victim had alleged that since her complaint was against local police officials, the investigation which was undertaken by the Circle Officer attached to the same Police Station, would not be fair and transparent. She had prayed the Apex Court to transfer the investigation to the Central Bureau of Investigation (CBI) or to some other independent agency.
However, the Top Court ordered the transfer of investigation to a senior Police Officer in State capital Lucknow.
Two other highlighted custodial death cases are pending before the respective Courts in the State. In both the cases, CBI's involvement was sought.
In Kasganj Custodial Death Case a plea had been moved before the Allahabad High Court seeking CBI enquiry which is still pending and in Jaunpur Custodial Death case the High Court had come down heavily upon CBI for further delay in the arrest of the accused police officers.
