Thane Court Grants Bail To Sheezan Khan In Tunisha Sharma Murder Case

The sessions court granted bail to Khan while asking him to take prior permission from the court before leaving the court's jurisdiction. Khan's plea for quashing the FIR is pending before the high court.
Sheezan Khan, a television actor accused of abetting the suicide of his former partner Tunisha Sharma, was granted bail by the Sessions Court in Thane last week. Additional Sessions Judge RG Deshpande granted bail to Khan on the condition of executing a personal bond of Rs. 1 lakh.
Court directed Khan to submit his passport and take prior permission from the court before leaving the jurisdiction of the court.
Khan was arrested on December 25, 2022, and charged under Section 306 of the Indian Penal Code (IPC), which deals with the abetment of suicide. Sharma, who was 21 years old, was found hanging in the washroom on the shooting set of a Hindi tv serial near Vasai on December 24, 2022
During their time together on the television show "Ali Baba: Dastaan-E-Kabul", Sharma and Khan were in a relationship. However, they had broken up prior to Sharma's death. Khan argued that the investigation is now complete and a chargesheet has been filed.
Khan has also filed a petition in the High Court to quash the FIR lodged against him and seeking bail in the case. However, the Bombay High Court has asked Khan to approach the Sessions Court to seek bail.
In his plea, Khan argued that he cannot be held responsible for Sharma's death since the ingredients of Section 306 were not fulfilled.
Khan's lawyers further argued that entering into a relationship and breaking up is an everyday facets of life, and if two persons in such a relationship terminate it, then the mere fact that the other person commits suicide does not justify the offense registered under IPC Section 306 with its consequences of arrest and custody.
Khan has also claimed that there is nothing to show he had done any act with the specific intention of compelling Sharma to die by suicide.
Meanwhile, Khan walked out of Thane Central Jail on Sunday.
