Tripura HC Transfers Civil Judge Accused of Sexual Harassment By Woman Who Came To Record Statement In Rape Case

In a recent development, the Tripura High Court has transferred Civil Judge Biswatosh Dhar of the Kamalpur subdivision following allegations of sexual harassment by a rape survivor. 

The incident reportedly occurred in his chamber during the woman’s statement recording on February 16. The woman, who had gone to record her statement in a rape case, accused the first-class judicial magistrate of groping her in his chamber. Following her ordeal, she reported the incident to the Additional district and sessions judge in Kamalpur.

The woman claims that the incident, causing immediate distress, led her to leave the chamber swiftly and inform the present lawyers and her husband. Following this, her husband also filed a separate complaint with the Kamalpur Bar Association.

Following the accusations, the Tripura High Court released a notification on February 23 stating that "Sri Biswatosh Dhar, Civil Judge (Jr. Div.)-cum-Judicial Magistrate First Class, Kamalpur, Dhalai District is hereby transferred to the High Court and is kept on compulsory waiting for future posting," highlighting the judiciary's response to the serious allegations made against him.

In addition to the transfer, considering the grave accusations, the High Court has also initiated an investigation, led by a three-member panel headed by District and Sessions Judge Gautam Sarkar. The investigation aims to gather evidence and determine the next steps in the case.

Meanwhile, the civil judge has been placed on compulsory waiting for future postings, with his responsibilities reassigned to Smt. Madhumita Biswas, as per the notification. 

The civil judge has also been directed to report to the High Court immediately.
