Sengar received a life imprisonment sentence for the sexual assault of a minor girl in Unnao District, Uttar Pradesh, in 2017. Additionally, he was convicted and sentenced to a 10-year prison term in connection with the custodial death of the father of the Unnao rape victim.
The Delhi High Court, on Thursday, granted ex-MLA Kuldeep Singh Senger a two-week interim bail on medical grounds. The bench of Justice Prathiba M. Singh and Justice Amit Sharma had directed AIIMS to submit a comprehensive medical assessment.
The court, in June 2024, denied an appeal seeking suspension of his sentence, emphasizing that “once an accused is convicted, the presumption of innocence is no longer applicable”.
The court highlighted that any application for the suspension of a sentence must be assessed based on the convict’s role in the offense and the severity of the crime, as established in the conviction judgment.
Justice Swarana Kanta Sharma, while delivering the judgment, observed that the period served by a convict is only one among several factors to be considered when deciding on applications for suspension of sentence. Other considerations, such as the gravity of the offense, the nature of the crime, the convict’s criminal history, and the potential impact on public confidence in the judiciary, also played a critical role in such determinations.
In December 2022, Sengar was sentenced to life imprisonment for raping a minor girl in Unnao in 2017. He previously sought a two-month interim bail for his daughter’s wedding, which was approved by a division bench led by Justice Mukta Gupta and Justice Poonam A. Bamba.
