‘Video Was Neither Fake Nor Edited’: X Notifies Delhi HC In Journalist Rajat Sharma’s Defamation Suit

Synopsis

X Corp sought to overturn the court's interim order requiring the platform to remove the video by Congress leaders Nayak, Jairam Ramesh, and Pawan Khera. The social media platform contended that the unedited footage, still available on India TV’s YouTube channel, shows Sharma uttering the disputed words, contrary to his denial.

X Corp (formerly Twitter), recently, notified the Delhi High Court that the video posted by Congress leader Ragini Nayak, alleging that journalist Rajat Sharma abused her on live TV, was neither edited nor fake. 

The bench of Justice Manmeet Pritam Singh Arora listed the matter for further adjudication on August 22, 2024. 

Rajat Sharma had filed a lawsuit seeking a permanent injunction and damages of INR 100 crores, alleging that several Congress leaders misrepresented his conduct during a televised debate on India TV Channel and shared edited footage on social media. 

Senior Advocate Rajshekhar Rao, represented X, arguing that Sharma's own transcript incorrectly stated he said nothing offensive. Conversely, the video showed otherwise, thus invalidating Sharma's claim and necessitating the dismissal of his suit.

Senior Advocate Prashanto Chandra Sen, representing the Congress leaders, also sought to vacate the injunction order. Meanwhile, Senior Advocate Sandeep Sethi, on behalf of Sharma, argued that the Congress leaders had not complied with the court’s directive to remove the tweets, only geo-blocking them.

The bench had instructed that the tweets be unblocked by July 12, and deleted by the Congress leaders within an hour of unblocking.
