Vikas Dubey Encounter Case: Supreme Court Constituted Panel gives clean chit to Police

The three member Judicial Commission formed as per the directives of the Supreme Court in the Gangster Vikas Dubey Encounter case placed its reports before the Uttar Pradesh Legislative Assembly on Thursday.

The commission headed by retired Supreme Court judge Justice B S Chauhan,  with retired Allahabad HC judge Justice Shashi Kant Agarwal and former UP Director General of Police K L Gupta as its members have cleared Police action holding that there was enough evidence that Dubey and his gang were patronised by local police, revenue and administrative officials.

The Commission had submitted its investigation report to the state government in April this year which was tabled before the Assembly on August 19

The report concluded with the observation that “evidence relating to sequence of events which ultimately resulted in the death of accused Vikas Dubey do not raise any kind of suspicion or doubt about the genuineness of police version of events”

The Commission has however recommended an inquiry against the “erring public servants”.

Last year the Supreme Court bench headed by Former Chief Justice SA Bobde while hearing a batch of pleas seeking a court monitored inquiry into the deaths of Gangster Vikas Dubey and his associates  had formed a three member probe panel.

In its investigation report the commission has said that not a single witness has come forward against the claims of the police encounter of  Vikas Dubey and his associates.

The commission has also raised questions on the state machinery in its report. The report stated that despite 64 cases filed against Vikas Dubey, no attempt was ever made to appoint a Special Prosecution Officer to bring punishmet in his cases. No application was ever filed by the state in the Court for the cancellation of his bail nor did the court ever approach a high court against him.

Dubey was the main accused in the encounter that took place in Bikru village in the Chaubeypur area of Kanpur, in which a group of assailants opened fie on a police team which had gone to arrest him in July this year. Eight police personnel were killed in the encounter.
