West Bengal Violence: Calcutta High Court directs police to register cases on post-poll violence, conduct autopsy on body of BJP Worker Avijit Sarkar

The Calcutta High Court today directed the West Bengal Police to register cases on the recommendations of the National Human Rights Commission (NHRC) in connection with post-poll violence in the State and continue with its fact finding mission till July 13.

The Five Judge bench led by Acting Chief Justice Rajesh Bindal and Justices IP Mukerji, Harish Tandon, Soumen Sen and Subrata Talukdar also instructed the State to ensure proper medical treatment to all victims and provision of ration to all affected even to those not having ration cards.

The Court has also issued show cause notices to the District Magistrates and Superintendant of Police of Jadavpur asking as to why contempt proceedings should not be initiated against them.

It also directed that second autopsy be carried out on the body of deceased Bharatiya Janata Party worker Avijit Sarkar who was allegedly killed during the clashes.

The Committee had submitted its report on June 30, however the Committee requested the Court for further time in order to place before the Court a comprehensive report after visiting the affected places.

The Court has now listed the matter for next hearing on July 13, 2021.

The National Human Rights Commission Chairperson (Former Supreme Court Judge) Justice Arun Mishra, constituted a Committee to enquire into the complaints of post poll violence in West Bengal, in accordance with the previous orders of the High Court of Calcutta.

The Committee is headed by Shri Rajeev Jain, Member, NHRC to enquire into complaints of post poll violence in West Bengal. 

The National Human Rights Commission Chairperson (Former Supreme Court Judge) Justice Arun Mishra, constituted a Committee on June 21 to enquire into the complaints of post poll violence in West Bengal, in accordance with the previous orders of the High Court of Calcutta.

 

“The Committee shall examine all the cases and may be by visiting the affected areas and submit a comprehensive report to this Court about the present situation and also the steps to be taken to ensure confidence of the people that they can peacefully live in their houses and also carry on their occupation or business to earn their livelihood.” – the Court had observed.

It is pertinent to note that just two days ago, Call for Justice, as a responsible Civil Society Organisation (CSO) constituted a Fact- Finding Committee to inquire into the Post Poll violence in West Bengal.

The committee had found that instances of violence were of a wide magnitude in the State and that it was apparent that the targeted destruction and vandalism had political patronage.
