Atul Subhash Suicide Case| PIL before SC seeks review of existing dowry laws citing men's mental health

"That this not only about one Atul Subhash but there have been lacs of men who have committed suicide because of multiple cases showered upon them by the wives. The gross misuse of the Dowry laws have defeated the purpose of these laws for which they were enacted...", top court has been told

A PIL has been filed before Supreme Court of India owing to drastic condition and fate of married men in India after implication in false Dowry and Domestic Violence cases.

Citing the recent tragic suicide of Atul Subhash, a 34-year-old techie in Bengaluru, the plea submits that Dowry Prohibition Act and Section 498A of IPC which were meant to protect the married women, have become weapons to settle unnecessary and illegal demands and to suppress the husband's family when any other dispute arises between husband and wife.

Subhash's suicide has triggered a nationwide debate on marital discord, the misuse of dowry prohibition laws and also men's mental health. Before he died by suicide, Subhash recorded an 80-minute video accusing his estranged wife and her family of slapping multiple cases on him and his family to extort money from them. He has also criticized the justice system in his 24-page suicide note. 

The instant PIL filed by Advocate Vishal Tiwari submits that false implication of married man leads to real and true incidents against the women being looked at with suspicion. There have been many incidents and cases of false implication of men in dowry cases which has led to very tragic end and also raised question on our justice and criminal investigation system, the plea adds.

"That these cases not only impact the lives and career of husbands and wives but also have very deep impact in negative form upon their children. It effects their mental health behaviour which could result in the ruin of their proper growth.", court has been told.

Referring to the case of Preeti Gupta vs. State of Jharkhand, review and reforms in existing Dowry laws and Domestic Violence Act has been sought to stop its misuse.

A further direction is sought to constitute an expert Committee comprising retired judges, lawyers and eminent legal jurists headed by former Supreme court justice to review and reform the existing Dowry and Domestic violence laws and give suggestions to prevent their misuse.

It has also been sought that with every Marriage Registration Application the list of Articles/Gifts/Money given during the marriage shall also be furnished with Affidavit and the record of same shall be kept enclosed with the Marriage Registration certificate.
