Bombay High Court stays declaration of results of MBA/MMS CET results as they file writ highlighting discrepancies

The Bombay High Court on Wednesday stayed the declaration of results of the 35 aspirants who took Maharashtra Common Entrance Test (CET) conducted for MBA/MMS courses till 11.10.2021.

The order was passed by a bench of Justices R.D.Dhanuka and Abhay Ahuja in a petition filed by aspirants who took the test on the ground that the examination was not conducted in accordance with the information prescribed in the brochure. 

The tests were conducted online on 16th, 17th and 18th of September in morning and afternoon slots on each dates. The petition states that the information brochure had categorically stipulated the topic/subject wise marking scheme, however it was not followed in the examination from one slot to another. The results of these exams scheduled to be declared on 28.09.2021

According to the petition, the petitioners sent an email to the Common Entrance Test Cell (CET Cell) on 23.09.2021 requesting a re-exam after removing such discrepancies, they also followed up on the status of their representation on 27.09.2021, however the CET cell did not respond to the same. The petition states that some of them have preferred an application under the Right to Information act seeking question paper and model answer sheets. The petition states that since all their representations went unanswered and they are still awaiting the response for the RTI, they have approached the court seeking a stay. The petition states that by not following the information provided in the brochure, the CET cell has violated the Unaided Private Professional Educational Institutions (Regulation of Admission and Fees) Act, 2015. The petition also urges constitution of an expert committed to understand the discrepancies and conduct a re-exam based on the report of the committee.

It is stated that the petitioners have completed their bachelor’s degrees from various universities and aspire to pursue their masters and some of the aspirants who had taken the tests had left their jobs. The petition states that the officers of CET cell are acting in an unreasonable manner by not hearing their grievances.

The court ordered notice to the CET cell and directed the petitioners to serve it to them in 48 hours from 06.10.2021. The matter will now come up for admission on 11.10.2021
