Synopsis

Court further said that the plea should have been mentioned before CJI Chandrachud, rather than coming in an IA in a pending plea on the issue of hate speech.

The Supreme Court today refused to hear a plea mentioned before it against the release of movie The Kerala Story.

Advocate Nizam Pasha mentioned the plea before a Justice KM Joseph led bench alleging that the film promotes hate speech.

The movie starring Adah Sharma is slated to release on this Friday, May 5.

"Why don't you move the High Court, we cant' tag it. A board has certified it, the film has gone through the process", Justice KM Joseph remarked.

At this juncture, Senior Advocate Kapil Sibal told court that the bench could read the transcript during recess. 

"A proper petition would be filed by tomorrow", Sibal added.

Hearing this, the bench also comprising Justice BV Nagarathna said that the plea should have been mentioned before Chief Justice of India.

"We will mention tomorrow, but by the time it is listed, it will be released", Sibal replied.

"You cannot come here directly.. Such an IA cannot be filed in a pending plea", Justice Nagarathna said while refusing to hear the plea.
