"Carve out an exception": Supreme Court asks Govt to allow disability pension to Kargil war veteran suspended on disciplinary grounds

The bench was hearing a plea filed by the Central Government challenging the order allowing disability pension to the veteran, Naginder Singh, passed by the Armed Forces Tribunal.

The Supreme Court on Monday asked the Central Government to carve out an exception and consider providing disability pension to a Kargil war veteran who was suspended on disciplinary grounds due to alcohol dependency.

A bench of Justice DY Chandrachud and Justice Sudhanshu Dhulia said, "One must look at the human side of justice as well. This person has served in the front, if we interfere with his pension now, it will affect his family.”

The bench was hearing a plea filed by the Central Government challenging the order allowing disability pension to the veteran, Naginder Singh, passed by the Armed Forces Tribunal. Naginder Singh was suspended on disciplinary grounds due to alcohol dependency.

Justice Chandrachud said, “These people serve the nation. Over the weekend we saw the deaths of two young airforce officers, it shakes you up.”

Additional Solicitor General Madhavi Divan had submitted that the petitioner is not entitled to the pensionary benefits as alcohol dependency is considered a serious offence in the forces.

However, the bench while asking the government to consider allowing pension to Singh, said that otherwise, this will affect his family.
