Centre proposes bills replacing Indian Penal Code, Criminal Procedure Code And Indian Evidence Act

Synopsis

The proposed bills will be referred to the Parliamentary Standing Committee for further deliberation

The Union Government proposed three new bills in the Lok Sabha yesterday, replacing the Indian Penal Code, 1860, Criminal Procedure Code, 1973 and the Indian Evidence Act, 1872.

The nomenclature as proposed for the new laws is as follows;

  1. Indian Penal Code, 1860 renamed as Bharatiya Nyaya Sanhita, 2023 [Chapters – XIX, Sections – 356]
  2. Criminal Procedure Code, 1973 renamed as Bharatiya Nagarik Suraksha Sanhita, 2023 [Chapters – XXXVIII, Sections – 533, Schedules – II]
  3. Indian Evidence Act, 1872 renamed as Bharatiya Sakshya Bill, 2023 [Parts – IV, Chapters – XI, Sections – 170 and a Schedule]

As per the address of Home Minister Mr. Amit Shah, the aforesaid bills will be sent to a Parliamentary Standing Committee for further deliberation.

“Under Bharatiya Nagarik Suraksha Sanhita, 2023, 160 sections have been amended, 9 new sections have been introduced and 9 sections have been deleted. Under Bharatiya Nyaya Sanhita, 2023, 175 sections have been amended, 8 new sections have been introduced and 22 sections have been deleted. Under Bharatiya Sakshya Bill, 2023, 23 sections have been amended, 1 new section has been added and 5 sections have been deleted”, the address of the Home Minister further added.

Notably, Section 124A of IPC- Sedition stands deleted in the proposed Bhartiya Nyaya Sanhita, 2023.
