Before High Court, prosecution had claimed that without active involvement of the present applicant, the above organized crime syndicate could not have sustained its activities
The Delhi High Court on April 2, 2024 has granted bail to Superintendent, Jail No.10, Rohini, namely Sunil Kumar, who has been accused of helping and facilitating Sukash V Chandrashekhar in his criminal activities.
As per the allegations, the accused applicant knowingly assisted accused Chandrashekar in running the organized crime syndicate inside the jail premises, in lieu of hefty shares of the crime proceeds which he received regularly every month.
During interrogation, High Court noted, it was alleged that the accused applicant could not give any justification for allotting an entire barrack to Sukash and also allowing prohibited items like rope, extra bed sheets, sharp-edged objects, etc. in the said barrack.
Notably, Dharam Singh Meena, Assistant Superintendent, Delhi Prisons was also arrested in the instant case. Suring investigations Subhash Batra, Deputy Superintendent, Rohini Jail was also interrogated, who allegedly disclosed that he was involved in helping and facilitating SCS in his criminal activities.
In its order granting bail, a single judge bench of Justice Amit Sharma has noted that the applicant was arrested in 2021 and had undergone more than 2 years and 4 months.
"The trial is still at the stage of Section 207 of the Cr.P.C. and charges have not yet been framed. As per the record, there are total 21 accused and the prosecution has cited 371 prosecution witnesses and in these circumstances the trial is not likely to be completed in near future. Apart from the fact that the applicant has been able to satisfy the requirement under Section 24(1) of the Act, the aforesaid circumstances are additional factors for consideration of the present bail application..", the high court further noted in its order.
Accordingly, it has been directed that the accused Jail Superintendent shall be admitted to bail upon furnishing a personal bond in the sum of Rs. 5,00,000/- alongwith two sureties of like amount.
He has been further asked to not leave India without the prior permission of the Trial Court and to give all his mobile numbers to the Investigating Officer and keep them operational at all times.
"In case it is established that the applicant tried to tamper with the evidence, the bail granted to the applicant shall stand cancelled forthwith", the order adds.
