Delhi High Court issues notice in plea alleging forceful conversion, cruelty upon minor in CCI; challenges vires of provisions under JJ Act

The Delhi High Court has issued notice to the Centre and other impleaded parties in a plea filed by the mother of a minor child who has alleged that her minor child was forcibly 'indoctrinated' & converted to Christianity by the social workers of Evangelical Fellowship of India Commission on Relief (EFICOR) NGO and Prayas NGO.

The plea filed through Advocate Dibyanshu Pandey alleges that that the minor was "trapped" by social workers of the aforementioned NGO who got a false FIR of sexual abuse at her behest, following which she was produced before the Child Welfare Committee after five days, in direct contravention of the Rule 81 (1) of The Juvenile Justice (Care and Protection of Children) Model Rules, 2016. It is the case of the mother that the child was subjected to cruelty and exploitation for more than five months inside the child care institution run by Global Family Charitable Trust.

It is alleged that the child, who is a Hindu converted to Christianity without taking her mother's consent.

Aggrieved by the alleged abuse of authority and unchecked actions of the CWC, South District, Delhi, that caused exploitation of the daughter of the Petitioner in the Child Care Institution (hereinafter referred to as “CCI”) by various NGOs for more than five months, and caused forced indoctrination of the child in Christianity in the CCI, the mother has challenged the Constitutional validity of the Juvenile Justice (Care and Protection of Children) Act, 2015. 

She has further alleged that the provisions have caused "denial of justice to the petitioner and her daughter and violated the fundamental rights guaranteed by the Constitution of India".
