A letter petition has been filed addressing the Chief Justice of India, seeking a direction to the vacation bench headed by Justice Surya Kant to withdraw their observations made today while refusing to entertain a plea filed by Nupur Sharma.
This has been sought with a view to provide Sharma a fair trial.
Nupur Sharma, while speaking live in a TV debate, on the Gyanvapi Mosque issue, made certain comments on Prophet Mohammed, which triggered a row.
BJP, the party which she belonged to, subsequently suspended her and another party leader - Naveen Jindal amid controversy over the comment.
A division bench of Justices Surya Kant and JB Pardiwala today while refusing to entertain suspended BJP leader Nupur Sharma's plea seeking transfer of FIRs registered against her in many states to Delhi for investigation, had remarked that remarked that Sharma was single handedly responsible for what had happened in the country.
"She should apologise to the whole country for what she has done. We saw the statement made by her on TV”, said Justice Kant.
The top court further said that Sharma's statement was responsible for the unfortunate killing in Udaipur.
"Whether without trial or appeal or any judgment or finding of any court can this court made such statements which effect merit of the case as well as trial?", Gautam has further questioned.
The letter further alleges that when the Court has not examined that whatever was said by Sharma was right or wrong in the light of Quran and Haddis, it cannot declare her to be guilty.
Filed by activist Ajay Gautam, the letter petition seeks a declaration that the above mentioned observations made by the bench headed by Justice Surya Kant were uncalled for.
It has been further sought that all cases registered against Sharma be suo motu transferred to Delhi under article 20(2) of the Constitution.
The CJI has also been requested to direct fast track the trial keeping in mind the threats made to Nupur Sharma.
