Elderly seeks Rs 510 Crore compensation against Waqf property before Supreme Court

A plea in the Supreme Court has been filed seeking rupees 510 Crores compensation aginst a waqf property acquired by the Uttar Pradesh Government. The 80 years old petitioner submits that he is the legal heir of the waqf property.

The plea has been filed by one Alim Akhtar through Advocate Omprakash Parihar challenging the Allahabad High Court order wherein the court had refused to allow his claim allegedly due under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (LARR) Act, 2013.

The plea argues that the Allahabad High Court was blatantly erroneous as the issue involved before the Allahabad High Court was in respect of Waqf AlalAulad property i.e. the property which continues to belong to the descendants for all time to come. The Allahabad High Court grossly erred in concluding that the Petitioner was the owner of the land in issue from 110 years ago, the plea reads.

The plea states that "the petitioner is surviving legal heir who is 80 years old  and rightfully claims the compensation of Rs 510 crore which was denied by the District Magistrate, Fatehpur and hence the reliefs under the above Writ Petition ought to have been granted to the petitioner."

It further states that admittedly the State Government acquired the land in question and are in possession of the same since long back without giving any compensation and as such, they are bound to proceed under the provisions of the Land Acquisition Act, as such the entire action as well as the impugned orders are illegal and not sustainable under the eye of law.
