Estate Officer, Chandigarh directed to show cause after no one appears before Supreme Court on administration's behalf

Synopsis

ASG KM Nataraj, who had appeared before the Court in the matter earlier, told the bench that he was not instructed to appear before court yesterday.

After none appeared on behalf of the Union Territory of Chandigarh before the Supreme Court on Tuesday, despite the case being called out twice, the Top Court directed the Estate Officer, Union Territory of Chandigarh to remain present in Court.

In a serious matter pertaining to construction in the City of Chandigarh, which was specially fixed for hearing yesterday and directed to be treated as part-heard, there was no representation in the morning session on behalf of the Union Territory of Chandigarh.

Since, K.M. Nataraj, Additional Solicitor General had appeared on an earlier occasion in the matter, his name was flashed on the display Board.

A bench of Justices BR Gavai and BV Nagarathna was informed by ASG Nataraj, when he came to the Court, that he had not been instructed to appear in these matters.

Hearing this, the bench found the approach of the administration of the UT to be totally callous and irresponsible in dealing with important litigation.

"We, therefore, direct the Estate Officer, Union Territory of Chandigarh to remain present in Court tomorrow, i.e. 02.11.2022 at 11 a.m. and show cause as to why action should not be taken for dealing with such an important matter in a callous manner...", ordered a rather irritated bench.

The Registrar(Judl.) of the High Court of Punjab and Haryana was also directed to communicate the order to the Estate Officer, Union Territory of Chandigarh.

"For further arguments, list these matters tomorrow, i.e. 02.11.2022 as part heard matter at serial No.1", also ordered the court.
