The Supreme Court on Monday stated that the question of determining as to who shall be allowed to enter Delhi or not is to be decided by the Police.
"We have told the Attorney General before, whether who should be allowed to enter the city and who should not be allowed along with matters related to law and order are to be dealt with by the police. We are not the first authority to deal with this" said the Chief Justice of India SA Bobde after Advocate AP Singh made submissions with regard to permissions to hold protests in Ram Leela Maidan.
The Attorney General for India stated that the entry of 5000 people into Delhi is wholly illegal.
"Mr. Attorney, we are adjourning this, another bench is hearing you. You have time to invoke all your powers. We are not going to decide this and i know of no decision where we have had to intervene as the first authority," said CJI SA Bobde.
This is when the Attorney General asked the Court to stipulate the aforementioned in the order.
"If Your lordships can pass an order that the decision to do so is with the Police, it would be highly beneficial," said the AG.
CJI SA Bobde however said that the Union has powers stipulated under the Police Act and that there was no need for the Court to intervene and suggest so.
In this context, the Supreme Court adjourned the case(s) to day after tomorrow. The bench said that a bench of CJI SA Bobde, Justice AS Bopanna & V. Ramasubramaniun is hearing the matter originally and that today the bench headed by CJI Bobde was joined by Justices L. Nageswara Rao & Vineet Saran.
