Filling up judicial vacancies "prime urgency": Supreme Court refuses to defer examination

The petitions has been filed by judiciary aspirants seeking direction from the court to defer examinations of Madhya Pradesh, Rajasthan, and Bihar judiciary accordingly as the examination are scheduled on the same day.

The Supreme Court on Tuesday dismissed a batch of petitions filed by judiciary aspirants seeking the court's direction to reschedule the state judiciary examinations as the Madhya Pradesh, Bihar, and Rajasthan judiciary examinations are scheduled on the same day.

A bench of Justice SK Kaul and Justice MM Sundresh noted, "Filling up of judicial vacancies is of prime urgency. There appears to be some clashes of examination and earlier also some deferments took place and that too at the behest of a couple of students."

The order has been passed in a batch of petitions filed by judiciary aspirants seeking direction from the court to defer examinations of Madhya Pradesh, Rajasthan, and Bihar judiciary accordingly as the examination are scheduled on the same day.

The bench noted that the court cannot countenance a situation where exams are continuously deferred. 

"They are different examinations and the petitioner(s) will have to take a choice where he/they want(s) to appear as otherwise it causes grave prejudice to other candidates and to the examination process," the bench held.

The bench while dismissing the plea said that there are so many examinations can they say, they want to apply in all examinations and ask the Court to defer all of them accordingly.

The preliminary examination for the Madhya Pradesh judiciary is scheduled on July 24, 2022, whereas, the Mains examination for the Rajasthan judiciary is scheduled on July 23 to 24, 2022. Additionally, the Bihar Judiciary examination is scheduled for July 25, 2022.

It may also be noted that earlier, the top court had stayed the Haryana Judiciary (Mains) examination scheduled for May 6 to 8, 2022 as it was clashing with the date already fixed by the High Court of Madhya Pradesh for the Preliminary Examination of the Madhya Pradesh Judicial Services.
