The National President of Hindu Sena, Vishnu Gupta, has filed an impleadment application in Varanasi District Court to be a party in the ongoing Gyanvapi complex dispute. Gupta has alleged that the ongoing suit affects his right to practice religion as guaranteed under Article 25 of the Constitution of India, therefore, he must be allowed to implead in the matter as plaintiff.
The application has been moved in the Regular Civil Suit No.693 of 2021, currently being heard by the District and Sessions Judge Dr. AK Vishvesha, filed by Hindu devotees seeking the right to worship inside the premises of the Gyanvapi Mosque, on the ground that it was a Hindu temple and still houses Hindu deities.
Carving out his direct interest in the ongoing case, Gupta has alleged that the Adi Shri Vishveshwara Kashi Vishwa Nath Temple was destroyed and then was illegally occupied by the defendant parties, which is a brutal and blatant attack not only on his fundamental right guaranteed under Article 25 of the Constitution of India but it is an attack on his sacrosanct and most sacred place of worship i.e. Adi Shri Vishveshwara Jyotir Linga Temple.
"Therefore, the Applicant has direct interest in the protecting and preserving the religious character of Adi Shri Vishveshwara Jyotir Linga at Varanasi from illegal and unauthorized occupation by Defendant No.4," the application states.
Gupta further presses for his interest in the dispute, stating, "Defendant No.4 has made an all-out effort to change the character of the Temple unsuccessfully but succeeded in the concealment of deities from the public gaze. Therefore, as a devotee and as a member of the Hindu community, the Applicant has a direct interest in the aforesaid Suit."
Importantly, in his application, Gupta has claimed that during research and studies he has found certain evidence (documentary) about the self-incarnation of Adi Sri Visheswara Jyotir Linga at Varanasi, the existence of Maa Shringar Gauri idol, the presence of Sri Nandi Ji.
Gupta has claimed that he has carried out research and studies about the self-incarnation of the first Jyotir Linga known as “Adi Shri Vishveshwara Jyotir Linga” at Varanasi.
