‘Inclined To Cancel Bail’: Supreme Court Directs Maharashtra To Move Plea Against Ramesh Mhatre
Supreme Court indicated it may cancel Shiv Sena corporator Ramesh Mhatre’s bail in the Kalyan hospital doctors’ assault case and directed Maharashtra to file a cancellation plea
The Supreme Court on Tuesday indicated that it may cancel the bail granted to Shiv Sena corporator Ramesh Mhatre, accused of assaulting doctors at a hospital in Kalyan, Mumbai.
The Bench of Justices Vikram Nath, Sandeep Mehta and AG Masih, while hearing Mhatre’s plea challenging conditions imposed by the Bombay High Court while granting him bail, directed the State of Maharashtra to formally move an application seeking cancellation of his bail.
The matter has now been listed for September 7.
During the hearing, Advocate Siddharth Dharmadhikari appeared for the State of Maharashtra.
The Court indicated that the State should formally move an application seeking cancellation of bail. “The State should have come in cancellation. You come in cancellation and cancel it,” the Bench said.
The State agreed to file the cancellation application on Tuesday itself.
“You will file it today?” the Bench asked.
Dharmadhikari responded in the affirmative.
“Have it on Monday,” the Bench directed.
The Bombay High Court had earlier granted Mhatre bail in the case subject to a condition that he would not reside in Maharashtra until charges were framed against him. The High Court had also prescribed timelines for completion of the trial.
Pursuant to the condition, Mhatre has been residing in Goa.
Mhatre approached the Supreme Court challenging the High Court's order, primarily arguing that the High Court could not have fixed timelines for completion of the trial. He also sought relaxation of the condition requiring him to stay outside Maharashtra and permission to return to Mumbai.
During the hearing, however, the Supreme Court indicated that it was inclined to cancel the bail itself, rather than consider relaxation of the conditions.
The Bench accordingly directed the Maharashtra Government to file an appropriate application for cancellation of bail.
The matter will be taken up again on September 7, when the State's application is expected to be considered.
Background
The proceedings arise from allegations concerning the assault of doctors and staff at a hospital operated by the Kalyan-Dombivli Municipal Corporation.
Notably, in August the division bench of Bombay High Court had ordered the release of Shiv Sena corporator Ramesh Mhatre from judicial custody, subject to strict conditions. The bench had lifted the stay it had earlier placed on Mhatre's bail. The Court, however, directed that he must stay outside Maharashtra until the police file the chargesheet in the case. It also ordered that the trial be assigned to a fast track court and fixed strict timelines for the state to carry the criminal proceedings forward.
