'Ironic, tragic and biggest scar on Indian democracy that criminal like him are lawmakers': Allahabad High Court denies bail to Mukhtar Ansari

Ansari, who has 56 criminal cases including 14 murder cases to his credit, is accused of registering an ambulance on forged & fabricated documents which was allegedly being used to carry his men with illegal weapons to escort him, in the present case.
The Lucknow Bench of Allahabad High Court on Tuesday rejected the bail plea of 5-time Member of Legislative Assembly from Mau constituency in Uttar Pradesh Mukhtar Ansari in a fraud case.
Taking note of Ansari's criminal background, the bench of Justice Dinesh Kumar Singh said, "It is irony and tragedy of the Indian republic and biggest scar on Indian democracy that criminals like the present accused-applicant are the law-makers."
Ansari's criminal history revealed 56 criminal cases, of which 14 are murder cases under Section 302 along with 364-A and 307 IPC etc. In the instant case, he is accused of registering an ambulance on forged & fabricated documents which was allegedly being used to carry his men with illegal weapons to escort him.
Agreeing with prosecution's apprehension that if released on bail he might tamper with the evidence and influence the witnesses, Court observed, "(Mukhtar Ansari) commands un-parallel fear in the minds and hearts of the people that no one dares to challenge him and his men and his politics".
As per the prosecution case, in December 2013, an ambulance was registered in the Transport Department of Barabanki in name of one Dr. Alka Rai. A letter was submitted that the said ambulance would be attached to Sanjeevani Hospital and Research Center Private Limited, Mau. However, in April 2021, it came to the notice that the said ambulance was being run without fitness and insurance which had expired in 2017.
Initially, the First Information Report was registered against Dr. Alka Rai and others, however, when the matter was investigated, Dr. Alka Rai admitted that Mukhtar Ansari's men had brought some documents to her and she was pressurized to put her signature on those papers.
The case was registered under Sections 419, 420, 467, 468, 471, 120-B, 177 and 506 IPC and Section 7 Criminal Law Amendment Act.
Dr. Alka Rai in her statement said that she was under pressure and fear of Ansari and after the news channel made the disclosure of the above incident his men told her what was required to be said by her to the police.
The Special Judge (MP/MLA)/Additional District Judge, Barabanki rejected Ansari's bail plea in December last year.
Taking note of the material on record and submissions made, the high court concluded, "The long criminal history of the accused-applicant of most heinous offences and looking at the facts of the case that the ambulance was allegedly being used to carry his men armed with illegal and sophisticated weapons for his protection, this Court finds that there is no ground to enlarge the accused-applicant on bail."
