Justice BR Gavai Recuses From Hearing Ex Top Cop Parambir Singh’s Plea Seeking Shifting Of Departmental Enquiry

Supreme Court Justice BR Gavai recused from hearing a plea filed by ex top cop Parambir Singh seeking for shifting departmental enquiries instituted against him.
“Brother has some difficulty in taking the matter. We'll just say to list before another bench. Mr Bali, I can't hear the matter. ”, Justice Vineet Saran said.
The petition was listed before the Vacation Bench of Justice Vineet Saran & Justice BR Gavai.
Sr Advocate Puneet Bali appearing for Parambir Singh submitted, "Kindly see the witch hunt which is happening here."
Param Bir Singh approached the Top Court alleging that departmental enquiries were instituted against him as part of a conspiracy to frame him for levelling allegations of corruption against Anil Deshmukh, who resigned as Maharashtra’s Home Minister.
Singh while calling the action against him as a “witch hunt” submitted that he was facing threats of multiple enquiries & probe unless he withdrew his complaint against Anil Deshmukh & thereafter urged to shift the enquiries to another State.
Expressing no confidence with the probe under the Maharashtra Govt, Singh along with seeking transfer of all departmental enquiries already initiated into other state had sought for directing the CBI to act on the representation made against the alleged threats made by the Maharashtra Government’s inquiry officer & for transfer of enquiries already initiated or contemplated for any punitive prosecution to an independent agency by the CBI.
The matter is expected to be heard either on Friday or next week before a Bench of which Justice BR Gavai is not a member.
