Kangana Ranaut Seeks Transfer Of Cases From Bombay To A Competent Court In Shimla On Account Of ‘Threat To Life’ And ‘Personal Vendetta Of Shiv Sena Leaders’

Kangana Ranaut has moved a Transfer Petition to the Supreme Court under Section 406 CrPC, seeking transfer of three cases registered and pending against her, from Bombay to a Court of competent jurisdiction in Shimla, Himachal Pradesh. 

Details Of Cases Sought For Transfer

  1. Case registered on the complaint of Mr. Ali Kashif Khan Deshmukh, a public spirited citizen and a practising lawyer, against the tweets made by the petitioner and her sister Rangoli Chandel (Petitioner 2), expressing deep anguish at the attack on Doctors who went for Corona check-up of the family of a man who died due to COVID 19. FIR has been lodged under Sections 153A, 153B, 295A, 298, 505 read with Section 34 IPC. The same complainant has also filed a subsequent case before the 66th Metropolitan Magistrate, Andheri, Mumbai.
  2. Complaint case lodged by Mr. Javed Akhtar, renowned poet and lyricist, against certain remarks made by Petitioner 1 in a TV show aired on 20.07.2020, under Sections 499 and 500 IPC. 
  3. FIR lodged by Mr. Munawar Ali also known as Sahil Ashraf Ali, against a tweet wherein the Petitioner points out the attitude of the Maharashtra Government, under Sections 153A, 295A, 124A read with Section 34 IPC.

Grounds Preferred

  1. Threat unto life if the trials proceed in Mumbai because of personal vendetta of Shiv Sena leaders against the Petitioner herein.
  2. The fact that the Petitioner has been conferred Y plus security of the CRPF reflects the imminent threat to life and property of the Petitioner as insisted above.
  3. Shiv Sena will leave no stone unturned to eliminate the Petitioners herein, because of the Petitioner’s continuous outspokenness against the wrongs done by the Shiv Sena in collusion with big names of the Bollywood.
  4. That the Petitioner agrees to fulfil all necessary criteria and grounds required for Transfer of the said cases.
  5. No prejudice will be caused to the Respondents in case the present petition is allowed.

Further, Petitioner places on record the prior acts of the Maharashtra Government, including abusive remarks by a Senior Shiv Sena leader, Mr. Sanjay Raut and the demolition of the Petitioner’s Pali Hill Bungalow, which was later declared ‘illegal’ and ‘smacked with mala fides’ by the Bombay High Court.
