Mumbai Court Grants Anticipatory Bail To UBT Faction Member Booked For Making Comments Against Eknath Shinde

A Sessions Court in Mumbai has recently granted anticipatory bail to a UBT Faction Member for making offensive comments against the Chief Minister of Maharashtra Eknath Shinde.

Judge Ashish Ayachit of the Dindoshi Sessions Court was hearing the anticipatory bail plea of Hemant Palav of the UBT faction booked under Sections 506 (punishment for criminal intimidation), 153A (promoting enmity between different groups) of the Indian Penal Code, and Section 67 (transmitting obscene material in electronic form) of the Information Technology Act.

The complainant claimed that there was a Facebook post on a regional news channel about Eknath Shinde, to which Palav had commented, amounting to outraging the modesty of a woman.

The prosecution opposed the plea, stating that if Palav were granted relief, there is a possibility that he might threaten witnesses in the case.

Palav contended that custodial interrogation is not warranted and that it is a politically motivated case.

He added that the complainant and Palav were from the same party but have now separated.

The Session Court Judge stated that custodial interrogation of the applicant is not at all necessary and warranted.

“Having gone through the above comments and considering the facts and considering the nature of offence, its punishment I am of the considered opinion that custodial interrogation of the applicant is not at all necessary and warranted,” the order reads.

Therefore, the court granted anticipatory bail to Palav, subject to the payment of ₹15,000 as a bail bond in the event he is arrested.

However, the court directed Palav not to make any comments in respect of the present case that may hurt the feelings of the public at large.
