No Relief For Bhima Koregaon Violence Accused Stan Swamy As Special Court Rejects Bail Plea

A special court on Monday rejected the bail application of alleged CPI(Maoist) member, Stan Swamy, arrested by the National Investigation Agency (NIA) in the Elgar Parishad case.
Swamy has been lodged in Taloja Jail for the last five months after being arrested by the National Investigation Agency for his alleged involvement in the violence that occurred in Bhima Koregaon on January 1, 2018.
It was averred in the bail plea that his arrest was mala fide and that his custody was not sought for over two years after the alleged incident.
It has been stated in his application that Swamy has been targetted by NIA due to the “nature of his writings and work”.
The NIA chargesheet filed against Swamy had claimed that he is a member of banned organization CPI (Maoist), and that he was given the responsibility of spreading its activities after the arrest of many party members.
In October last year, Swamy had filed a plea seeking interim bail in light of the guidelines enunciated for decongestion of prisons due to the pandemic.
The NIA had however objected to his prayer stating that,
“The accused Stan Swamy under the garb of the current situation on account of the global pandemic Covid-19 is trying to take an undue benefit of the situation…in seeking bail….,”
