Plea In Supreme Court Seeks Ban On Mass Rallies & Ongoing Elections

Aggrieved by the different inaction by the concerned Authorities in State of West Bengal, Assam, Tamil Nadu & Pondicherry, where millions of people without following the guidelines issued by the HMA & Health Ministry are gathering in mass election rallies, a Plea has been filed in Supreme Court seeking ban on mass rallies & ongoing elections.

India is currently showing a weekly national average positivity rate of 5.65% with Maharashtra showing a weekly average of 23.4%, Punjab (8.82%), Chhattisgarh (8%), Madhya Pradesh (7.82%), Tamil Nadu (2.50%), Karnataka (2.45%), Gujarat (2.2%) and Delhi (2.04%)”, the plea states.

It has been argued that the Central Government & State Government have failed to take action against those leaders who are responsible for the mass gatherings which are playing a major role in the spread of CoVID 19.

The plea has been preferred by Mr Vishal Thakre, Advocate & has been drawn by Advocate Pradeep Kumar Yadav & filed by Advocate on Record Sanjeev Malhotra.

The petitioner in the plea has averred that the Government & authorities have failed to take necessary measures for the health safety of the general public at large.

In this context the plea states that, “Government had imposed lockdown & unlocked thereafter but failed to take adequate measures for safety of the Citizens; no medical bulletin was published for people at large nor any information was provided to the residents/citizens/voters of the Country.

Further it has also been averred that the Election Commission permitted to conduct elections without taking into consideration the impact of the same on the general public. The petitioner in this context has further submitted that the elections were thereafter conducted in the State of Bihar & Bye Polls in several states in the month of November 2020 by not consulting the Health Ministry which thereby led to violating the CoVID 19 norms.

State have been hiding the actual figures of Corona Patients & projecting wrong figures. Incorrect messages are being spread pertaining to CoronaVirus or CoVID 19.”- excerpt from the plea.

Therefore the petitioner has prayed for issuance of a writ of Certiorari to call for the records directing the government to apprise with the steps taken by them from the period of March 2020 & March 2021 to cure CoVID 19 & has also prayed for banning mass rallies & stop ongoing elections till the time the situation improves.
