Plea in Supreme Court Seeks Constitution Of Special Investigating Agency To Look Into Dead Bodies Surfaced In River Ganga

A plea has been filed in Supreme Court seeking investigation against authorities responsible for suspicious death of hundreds of citizens, dead bodies of which have reportedly surfaced in river Ganga.

Petition has been moved by Advocate Pradeep Kumar Yadav through AOR Sanjeev Malhotra.

Prayer has been sought to issue a writ of Mandamus constituting a special investigating agency to supervise investigation of death of hundreds of human beings, whose dead bodies are found floating in river Ganga in Buxar of Bihar and Ghazipur, Unnao Districts of Uttar Pradesh.

Direction has been further sought to have post mortem of dead bodies found floating in the said areas.

Grounds inter-alia sought by the Petitioner;

  1. River acts as a source of water for surrounding areas, contamination of which can endanger several lives of many, including nearby villages.
  2. States have not taken any single step towards purification of water, violating Article 21 of the Constitution of India.
  3. States have failed to provide facilities for decent burial of dead bodies and have also failed to keep a check that river Ganga is not polluted by such inhumane act.
  4. Supreme Court in Parmanand Katara v. Union of India, 1995 3 SCC 248, held that the right to dignity and fair treatment under Article 21 is not only available to a man during his life but also to his body after death and the word ‘person’ in Article 21, would include a dead person in a limited sense.
  5. This may be a case of illegal dealing in organ transplantation wherein, some people might have brutally murdered the deceased(s) after removing their internal organs.
  6. States have failed to keep a check on its crematoriums where there is a huge hike in prices for cremating a dead bodies, given to the rise in fatalities due to COVID 19.

“Administration/Police Authorities has buried the dead bodies by preparing verbatim false Post Mortem reports which is to purpose of eye wash and to show that investigation was been conducted”, the plea adds.
