Plea In Supreme Court Seeks Investigation Against Unauthorised Transfer Of Krishna Janm Bhumi To Muslim Shahi Masjid Idgah
A plea has been filed in the Supreme Court seeking a direction against the unauthorized transfer of Krishna Janm Bhumi to Muslim Shahi Masjid Idgah by the Union of India.
Advocate Manohar Lal Sharma has preferred the plea arguing that the cause of action arose when the BJP leaders through compromise deed sold out Krishna Janm Bhumi to Muslim Shahi Masjid Idgah via registered deed dated 1968 & further arose when during March 2020 to September 2020 & March 2021 Shreekrishna Janm Sthan Sewa Sansthan through BJP leaders/member filed various suit in Mathura court declaring that Katra Keshav Deo belonged to diety Krishan & to create religion provocation for their political vested interest also declared under a planned conspiracy that they were worshippers/Sewayat.
“Its a serious injury & threat to the life & liberty to the citizen of India irrespective of religion coupled with being violative of Art 14 & 21. Krishna Janm Bhumi has been sold out to Muslim people without legal authortity by Shreekrishna Janm Sthan Sewa Sansthan society being controlled by the BJP, Hindu Mahasabha. The said sale/compromise between the society & Shahi Idgah has no legal value affecting any right upon Krishna Janm Bhumi & Muslim Shahi Masjid Idgah & is a criminal offence under Section 406, 420 of IPC”, the plea reads.
The petitioner has averred that the Ministry of Home Affairs & State of UP were duty bound to protect the Krishna Janm Bhumi & the entire trust property & that special police should be deployed upon it for safety & security. It has also been averred that the Janm Bhumi should be requisitioned by the government to protect it with the consent of life time trustees if the life time trustees are unable to manage the same.
It is also stated that BJP/RSS/Hindu Mahasabha members have filed the suit to grab Krishna Janm Bhumi under the garb of deity by declaring themselves as Sewayat to deity with the intent to provoke people for religious movement which would create disharmony in the area & in the country which would lead to several killing, riot, loot.
“This would create further centralization of vote banks in the favour of BJP party what they already did in the name of Ram Janm Bhumi to acquire the power in the centre & state”- excerpt from the plea.
In light of the above mentioned facts, the petitioner has also prayed for securing/ requisitioning trust property , to stop disharmony, riot/ killing for political object among the citizen of India coupled with further direction to investigate and prosecute all involved persons u/s 420,406 and 120-B of IPC & Trust in the interest of Justice. The petitioner has further prayed for issuing directions to protect Krishna Janm Bhumi by deploying special Security force & declare compromise deed dated 12.08.1968 executed as null & void.
